1. INTRODUCTION

By accessing or using MAI Calls (“we,” “our,” “us”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of our website (www.maicalls.com), our AI-powered receptionist system, and all associated features (collectively, the “Service”). If you do not agree to these Terms, do not use the Service.

We may update these Terms at any time. Updated Terms will be reflected by the “Effective Date” listed above. It is your responsibility to review Terms periodically.

2. DEFINITIONS

  • User: Any person or business accessing or using MAI Calls.

  • Service: The MAI Calls AI-powered receptionist platform.

  • Subscription: Monthly or annual payment for access to the Service.

  • Usage Fees: Pay-as-you-go charges incurred through AI call activity.

  • AI Receptionist: MAI Calls' automated voice system that handles inbound and outbound communications.

  • Caller ID: Phone number shown to recipients of outbound calls.

  • Content: All data created or transmitted via the Service, including call recordings, messages, and transcripts.

3. ELIGIBILITY

The Service is intended for users aged 18 and older. By using the Service, you affirm that you meet this requirement and are authorized to represent your business or entity.

4. SERVICE DESCRIPTION

MAI Calls provides businesses with a customizable AI-powered receptionist capable of:

  • Answering inbound calls 24/7

  • Making outbound calls for reminders, follow-ups, and lead engagement

  • Handling SMS text messaging

  • Booking appointments and collecting contact data

  • Logging transcripts, call data, and analytics in a secure dashboard

5. ACCOUNT SETUP

To use the Service, you must create an account. You are responsible for maintaining the security of your login credentials and for all activity under your account.

6. USER RESPONSIBILITY

You are solely responsible for:

  • The content and intent of all calls or texts conducted through MAI Calls

  • Ensuring your use of the Service complies with local, state, and federal laws

  • Providing consent and disclosures as required by laws like the TCPA

  • Honoring Do Not Call requests and maintaining internal suppression lists

You agree to indemnify and hold harmless MAI Calls against any legal actions, claims, fines, or liabilities resulting from your misuse or noncompliance.

7. PROHIBITED USES

You may not use the Service for:

  • Harassment, spam, or unauthorized marketing

  • Emergency response or critical medical support

  • Illegal, threatening, defamatory, or abusive behavior

  • Circumventing telemarketing laws or masking Caller ID

  • Interfering with the system or attempting to reverse-engineer MAI Calls

We reserve the right to terminate or suspend your account for any misuse.

8. SUBSCRIPTION & USAGE FEES

Access to the Service is subscription-based. Charges include:

  • Subscription Fees: Billed monthly or annually in advance.

  • Usage Fees: Additional per-minute fees apply based on usage.

Non-payment may result in immediate suspension or termination of your account. All fees are non-refundable.

9. CANCELLATION POLICY

To cancel your subscription, send an email to [email protected] at least 7 days prior to your next billing date. Cancellation requests received after this window will apply to the following billing cycle. No partial refunds or prorated credits will be issued for unused time.

10. REFUND POLICY

All services are delivered in real time and are non-refundable. Refunds will not be issued except in rare, case-specific scenarios and at the sole discretion of MAI Calls. To inquire, email [email protected] within 7 days of the billing cycle in question. No guarantee of refund is implied.

11. DATA & INTELLECTUAL PROPERTY

You own the content of your calls — meaning, anything you or your callers say, input, or share during a call belongs to you. However, MAI Calls retains full and exclusive ownership of all platform infrastructure, AI models, prompt logic, code, systems, interfaces, and proprietary tools that power the service.

MAI Calls does not guarantee the storage or long-term availability of call data, transcripts, or analytics. You are solely responsible for exporting and backing up any call content or client information you wish to retain. We do not provide retrieval services for deleted or lost data.

Use of MAI Calls does not grant you any license or claim to the underlying technology, nor does it permit reverse engineering, replication, or use of our systems outside of your intended access as a customer. All service elements are protected under intellectual property law.

We may use anonymized or aggregated call metadata for analytics and service improvement, but never in a way that reveals personal or private information.

12. PRIVACY & SECURITY

MAI Calls is committed to data security. We take reasonable precautions to safeguard information but cannot guarantee complete protection from all threats. Use of the Service is at your own risk. Please review our Privacy Policy for more details.

13. SERVICE AVAILABILITY

MAI Calls strives for 99.9% uptime but may experience interruptions for maintenance or upgrades. We reserve the right to modify or suspend features at any time.

14. DISCLAIMER OF WARRANTIES

The Service is provided "as-is" and "as-available." We make no guarantees regarding the performance, accuracy, or suitability of AI-generated outputs. You are solely responsible for reviewing and approving AI interactions before relying on them.

15. LIMITATION OF LIABILITY

To the maximum extent allowed by law, MAI Calls is not liable for indirect, incidental, special, or consequential damages related to your use of the Service. Your sole remedy is to discontinue use.

16. INDEMNIFICATION

You agree to indemnify and defend MAI Calls from all claims and damages arising from your misuse of the Service, violation of laws, or breach of these Terms.

17. TERMINATION

We reserve the right to suspend or cancel access to the Service for any violation of these Terms. You may cancel as outlined in Section 9.

18. DISPUTE RESOLUTION

All disputes shall be resolved through binding arbitration in Broward County, Florida under Florida law. Each party is responsible for their own legal costs unless otherwise ordered by the arbitrator.
