MAi Calls Terms and Conditions

1. INTRODUCTION

By accessing or using any product or service provided by MAi Calls LLC (“MAi Calls,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of our website (www.maicalls.com), our AI-powered receptionist platform, and all related tools and features (collectively, the “Service”).

If you do not agree to these Terms, you may not access or use the Service.
We may update these Terms periodically. The most recent version will always be posted with the current Effective Date. You are responsible for reviewing any updates.

2. DEFINITIONS

Client/User: Any individual or business accessing or using the Service.
Service: The MAi Calls platform and its products, including AI receptionist, Google review management, webchat widget, SMS/MMS messaging, CRM, funnels, calendars, and forms.
Subscription: A recurring payment granting access to the Service.
Usage Fees: Additional metered charges (texts, calls, etc.) billed at published rates.
Content: All data, messages, calls, texts, forms, or analytics transmitted or created through the Service.

3. ELIGIBILITY

The Service is intended for users 18 years or older. By using it, you represent that you meet this requirement and have authority to act on behalf of your organization.

4. SERVICE DESCRIPTION

MAi Calls provides business communication and automation tools designed to help companies manage customer engagement and scheduling. Features may include:

  • AI Receptionist (call answering, SMS follow-up, appointment scheduling, transcripts)

  • Reputation Management (automated Google review requests)

  • Webchat Widget (on-site chat routed to SMS)

  • 2-Way Texting & Missed Call Text Back

  • CRM & Pipelines (for leads and customer tracking)

  • Funnels, Forms & Surveys (for capture and feedback)

  • Email and Social Tools (for campaign management)

Features may be added, changed, or removed to improve performance and reliability.

5. ACCOUNT SETUP

Each Client receives a private sub-account for business use. Clients are responsible for maintaining login security and for all actions taken within their account.

6. USER RESPONSIBILITIES

Clients agree to:

  • Comply with all applicable marketing and communication laws (TCPA, CAN-SPAM, Do Not Call rules).

  • Obtain proper consent before sending any communications.

  • Maintain accurate billing details and keep payment methods current.

  • Use the Service only for lawful business purposes.

7. SUBSCRIPTIONS & FEES

  • Subscription Fees: Billed monthly in advance.

  • Usage Fees: Additional charges may apply for calls, texts, or add-ons.

  • Payment Defaults: Must be resolved within 48 hours to avoid suspension.

  • Refunds: All payments are non-refundable unless required by law.

8. CANCELLATION POLICY

Clients may cancel with at least 7 days’ written notice before the next billing cycle.
All plans are month-to-month; no long-term contracts.
No partial or prorated refunds for unused time.

9. PROHIBITED USES

Clients may not use the Service for spam, harassment, illegal activity, emergency calls, or attempts to reverse-engineer or bypass any platform components.

10. DATA OWNERSHIP

Clients retain ownership of their data (calls, messages, contacts, analytics).
MAi Calls retains ownership of its software, systems, and intellectual property.
Data may not be stored indefinitely; Clients are responsible for exporting or backing up needed data.

11. SERVICE AVAILABILITY

MAi Calls targets 99.9 % uptime but may perform maintenance or updates periodically.
We reserve the right to modify or discontinue features at any time.

12. TERMINATION

MAi Calls may suspend or terminate accounts for violation of these Terms, non-payment, or misuse of the Service.

13. LIMITATION OF LIABILITY

The Service is provided “as is.” MAi Calls LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
Your sole remedy is to discontinue use of the platform.

14. DISPUTE RESOLUTION

Any dispute shall be resolved by binding arbitration in Broward County, Florida, under Florida law.
